Terms of service

These terms are the agreement between you and us, Portfoliobox Stockholm AB, org. no. 556894-4382, VAT no. SE556894438201, Rånövägen 30, 168 39 Bromma, Sweden, caremcp@portfoliobox.net. Care MCP is our service. By creating an account, or by letting an assistant order for you, you accept these terms. Read them together with the privacy policy and the health data notice.

1. What Care MCP is

Care MCP lets an AI assistant you choose order a written document for you from a certified personal trainer or nutrition coach: a plan, an evaluation of a period or a review of a plan. The document follows a fixed template and is written for wellness and performance.

Care MCP is not health care. The professionals are not doctors, dietitians, nutritionists or physiotherapists, and nothing they write is a diagnosis, a treatment or medical advice. If you have an illness, an injury, symptoms, a pregnancy or an eating disorder, speak to a doctor first.

2. Who may use it

You must be at least 18 years old and able to enter into a binding agreement. The service is for healthy adults. Some orders are not available in some countries, and some answers on the health declaration mean an order is refused until a clinician has cleared you. We tell you why when that happens.

You give true and complete information about yourself, your health and your goals, and you order only for yourself. An organisation that orders for its own clients does so under the organisation terms, not these.

3. Your account and your assistant

You keep your sign-in to yourself and you are responsible for what happens on your account.

An assistant you connect acts in your name. It may place orders, read your orders and documents and see your credit. It may not pay and may not change your account. You revoke it at any time on your account page.

The assistant is made by another company, under that company's terms, and we do not control it. It decides what it sends us in a brief and how it retells a document to you. It may leave things out, get things wrong or add advice of its own. The document on your account page is the one the professional wrote, and it is the one that counts. What your assistant does with your data is covered by its maker's privacy policy, not ours.

4. Orders and delivery

An order is placed when your assistant sends it and your credit covers the price. We may refuse an order, and a refused order costs nothing.

A professional we have approved takes the order and writes the document. You buy from us, and we answer to you for the service. The professional reads your brief without your name, your email or your account.

Most documents are delivered within two days of a professional taking the order. That is a usual time and not a promise. If nobody has taken your order and you no longer want it, write to us and we withdraw it at no cost.

The document is delivered on your account and to the assistant that ordered it. If it does not follow its template, tell us and it is rewritten at no cost.

5. Prices and paying

You pay in advance into a credit, in euro if you live in the EU and in US dollars elsewhere. The currency is set when the account is made. Each delivered document is charged to the credit at the price shown when the order was placed. A refused or withdrawn order is not charged.

Consumers in the EU pay Swedish VAT on each deposit, added on top of the credit. Payments are handled by Mollie. A receipt is mailed for every deposit. Credit does not expire.

6. Refunds and your right of withdrawal

Unused credit is refunded on request, at any time, to the card or account it was paid from.

As a consumer in the EU you have a right to withdraw within 14 days. For a deposit, that right is covered by the refund of unused credit above. For an order, you ask us to begin at once when you place it, and you accept that your right of withdrawal ends when the document is delivered. If you withdraw after a professional has taken the order but before delivery, you pay a part of the price in proportion to the work already done. A delivered document is not refunded, unless it is faulty under section 4.

7. Using the documents at your own risk

Training and changing what you eat carry risks, including injury, pain, illness and in rare cases worse. A professional writes from what your brief says. They do not meet you, examine you or watch you train, and they cannot know what the brief leaves out.

You decide whether and how to follow a document. You follow it at your own risk and on your own judgement. Start carefully, stop and seek medical help if you feel pain, dizziness, shortness of breath or anything unusual, and see a doctor before you start if you are unsure whether it is safe for you. We do not promise any result.

8. What you may do with the documents

A document is for your own personal use. You may keep it, print it and share it with your doctor, your family or anyone who helps you. You may not sell it, publish it or offer it as a service to others. Everything else in the service, the site, the templates and the software, is ours or our licensors', and these terms give you no right to it beyond using the service.

9. What you may not do

You may not give false information, order for another person, use the service for anyone under 18, try to reach a professional outside the service, harass a professional, copy or scrape the service, break or test its security without our written permission, or use it against the law.

We may suspend or close an account that breaks these terms, and we tell you why. Unused credit on a closed account is refunded.

10. Our liability

We deliver the service with reasonable care and skill. Beyond that, and as far as the law allows, the service and the documents are provided as they are, and we do not promise that the service is always available or free of errors.

As far as the law allows, we are not liable for indirect loss, such as lost income, lost time or lost data, or for loss caused by how you or your assistant use a document, by information that was wrong or missing in your brief, by your assistant or its maker, or by events outside our control. Our total liability to you is limited to what you paid us in the twelve months before the claim.

Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, for personal injury caused by negligence, or your rights as a consumer under the law of the country where you live.

11. Complaints

Write to caremcp@portfoliobox.net and we answer within five working days. If we cannot agree, you may take the matter to the Swedish National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, arn.se. We take part in its proceedings.

12. Changes to these terms

We may change these terms. We tell you by email or when you next sign in at least 30 days before a change takes effect, unless the law requires a change sooner. If you do not accept a change, you may close your account before it takes effect and get your unused credit back. Using the service after that is accepting it.

13. Closing your account

You may delete your account at any time. Open orders are then withdrawn, your data is erased as the privacy policy describes, and unused credit is refunded on request.

14. Law and disputes

Swedish law applies, without its rules on choice of law. As a consumer you keep the protection of the mandatory law of the country where you live, and you may bring a claim in the courts there. Otherwise disputes are settled by the Swedish courts.
